What is Discrimination?
Unlawful discrimination occurs when a person is treated differently than others because of his or her membership in a legally protected group, class or category to which that person belongs rather than on individual merit. These groups, classes, or categories are referred to under the law as ‘protected classes.’ State and federal employment laws make it unlawful to discriminate against persons based protected classes such as:
- Race or ethnicity
- National origin
- Sexual orientation
- Military Status
Not all harassing, unfair or negative treatment constitutes unlawful discrimination. The reason you are treated differently or harassed is crucial in determining whether you have a legal claim of discrimination. If the reason is, for example, your age or gender or because you asked for help with your disability then you may have a discrimination claim. But if you are treated differently because, for example, your boss is a bully or a bad manager having nothing to do with your protected class, it is unlikely you have a claim no matter how unfair or disrespectful the treatment.
